When creating a prototype in Figma you can define this element as an overlay to add a hover effect (see Figma blog for a detailed description). Therefore, if your element is fixed behind the fold line, then it will not be visible when scrolling. You need a feature that Figma doesn’t have yet. Second: the frame needs to be smaller than the content in the direction you are planning to scroll, otherwise you will get a little warning when you set the scroll behavior.
